Terms of Use

In short. Nostalgia is yours to use for your own memories. Your entries belong to you and we never see them. If you share an album, treat the people in it well. Gold is billed by Apple, renews automatically unless you cancel, and you cancel it in your Apple Account settings rather than with us.

1. Agreement

These Terms of Use ("Terms") govern your access to and use of the Nostalgia application for iOS and iPadOS (the "App"), provided by Nostalgia ("we", "us", "our"). By downloading, installing or using the App you agree to these Terms. If you do not agree, do not use the App and delete it from your devices.

2. Who may use the App

You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian who agrees to these Terms on your behalf. By using the App you represent that you meet these requirements.

3. Your licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse engineer, decompile, resell, rent or redistribute the App or any part of it, except where that restriction is prohibited by law.

4. Your content stays yours

Everything you put into the App — text, photographs, places, recipes, lists and anything else — remains yours. We claim no ownership of it and no licence to use it. It is stored on your device and, if you use iCloud, in your own iCloud account, which we cannot access. We therefore cannot recover, restore, moderate or delete your content for you.

You are responsible for keeping your own backups. Deleting the App, signing out of iCloud, losing your device or losing access to your Apple Account may result in permanent loss of your entries, and there is nothing we can do to retrieve them.

5. Shared albums and how to behave in them

The App lets you create shared albums and invite other people. Shared content travels through Apple's CloudKit sharing, not through us.

You are solely responsible for what you choose to share and with whom. Anyone you invite can see, and may be able to copy or keep, everything in that album.

6. Acceptable use

You agree not to:

  • use the App for any unlawful purpose or in violation of these Terms;
  • interfere with, disrupt or attempt to gain unauthorised access to the App, Apple's services or anyone else's data;
  • circumvent, disable or attempt to defeat any purchase verification, entitlement check or other protective measure;
  • use automated means to access the App or extract data from the services it queries.

7. Nostalgia Gold, billing and cancellation

The App is free to use with limits on the number of items, photos per item and albums. Nostalgia Gold removes those limits. Gold is offered as:

  • a monthly subscription at $2.99 per month, with a 7 day free trial;
  • a yearly subscription at $29.99 per year;
  • a lifetime licence at $59.99 as a single, non-recurring purchase.

Prices are in US dollars, may vary by region, and are always as displayed at the point of purchase. All purchases are made through the Apple App Store and charged to your Apple Account.

Subscriptions renew automatically. Unless you cancel at least 24 hours before the end of the current period, your subscription renews and your Apple Account is charged for another period within 24 hours before the current one ends. You can manage and cancel subscriptions in your Apple Account settings on your device — not through us, because we cannot access your billing.

If you take the free trial and then buy a subscription, any unused portion of the trial is forfeited at the moment the purchase takes effect. Cancelling stops the next renewal; it does not end the period you have already paid for, and it does not trigger a partial refund.

Refunds are handled by Apple, under the App Store Terms of Service. We cannot issue, approve or deny a refund. Request one through Apple at reportaproblem.apple.com. The lifetime licence is a one-time purchase for the current App on your Apple Account; it is not a promise that the App, any specific feature, or any third-party service it relies on will remain available indefinitely.

8. Third-party services

Some features work by querying services we do not control — Apple Maps, Apple Music, Apple's book metadata, TMDB for film and television data, YouTube, and ride-hailing apps including Uber and Cabify. Your use of those services is governed by their terms and privacy policies. We do not control their content, availability, accuracy or pricing, and we are not responsible for them. A third-party service may change or withdraw its access at any time, which may cause a feature of the App to stop working.

9. Changes to the App

We may add, change or remove features, and may stop supporting older operating system versions. We aim to avoid changes that would make your existing entries unreadable, but we do not guarantee that any particular feature will remain available.

10. Disclaimer of warranties

The App is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement. We do not warrant that the App will be uninterrupted, timely, secure or error-free, or that data will never be lost. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or memories, arising out of or relating to your use of the App, whether based in contract, tort or any other theory, even if we have been advised of the possibility.

To the fullest extent permitted by law, our total liability arising out of or relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or twenty-five US dollars. Some jurisdictions do not allow these limitations, so they may not apply to you.

12. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss or expense, including reasonable legal fees, arising out of your misuse of the App, your violation of these Terms, or content you shared with other people through the App.

13. Termination

These Terms apply until terminated. You may terminate them at any time by deleting the App. We may suspend or terminate your licence if you materially breach these Terms, in particular the shared album rules in section 5. Sections 4, 10, 11, 12 and 14 survive termination. Termination of your licence does not by itself entitle you to a refund; refunds remain a matter for Apple.

14. Disputes

Before filing anything, please write to contact@getnostalgia.app. Most problems are faster to fix than to litigate, and we would rather fix them. Nothing in this section deprives you of the protection of mandatory consumer laws in your country of residence.

15. Terms required by Apple

Because the App is distributed through the App Store, the following apply and, where they conflict with anything above, they prevail:

  • These Terms are between you and us alone, not with Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide any maintenance or support for the App. Support requests go to contact@getnostalgia.app.
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
  • We, not Apple, are responsible for addressing any claim relating to the App, including product liability claims, any claim that the App fails to conform to a legal requirement, and claims arising under consumer protection or similar legislation.
  • We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that the App infringes that party's intellectual property rights.
  • You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

16. Changes to these Terms

We may update these Terms. If a change materially affects your rights, we will update the date at the top of this page and note it in the App's release notes before it takes effect. Continuing to use the App after a change takes effect means you accept the revised Terms.
